{"id":274,"date":"2008-09-17T20:48:21","date_gmt":"2008-09-18T00:48:21","guid":{"rendered":"http:\/\/wmlinfospot.wordpress.com\/?p=274"},"modified":"2016-07-20T16:14:30","modified_gmt":"2016-07-20T20:14:30","slug":"update-from-the-schemel-forum","status":"publish","type":"post","link":"https:\/\/sites.scranton.edu\/library\/2008\/09\/17\/update-from-the-schemel-forum\/","title":{"rendered":"Update from the Schemel Forum"},"content":{"rendered":"<p><a href=\"http:\/\/sites.scranton.edu\/library\/files\/2008\/09\/presidentialseal1.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-275\" style=\"margin:10px\" src=\"http:\/\/sites.scranton.edu\/library\/files\/2008\/09\/presidentialseal1.png?w=298\" alt=\"\" width=\"179\" height=\"180\" \/><\/a><\/p>\n<p>It&#8217;s now week three of this semester&#8217;s Schemel Forum on the American Presidency, and the debates just keep getting more interesting.\u00a0 Today, we were talking about the extents of executive power, and two of the philosophers present mentioned <a href=\"http:\/\/en.wikipedia.org\/wiki\/John_Locke\">John Locke<\/a>&#8216;s views on the power of a sovereign.\u00a0 Locke wrote in his <a href=\"http:\/\/www.gutenberg.org\/etext\/7370\">Treatises of Government<\/a> that a sovereign could act beyond the law under certain conditions &#8211; for example, if no laws yet existed to provide rules for a certain circumstance, or if the preservation of the public welfare were at stake.\u00a0 The hope was that the sovereign would be a wise enough ruler that these decisions could safely be left up to his discretion.\u00a0 We talked about how this idea could apply to the American presidency today &#8211; how far can the president go beyond stated laws in a time of emergency to protect the public?<\/p>\n<p>We only have two weeks left, and lots of material left to cover.\u00a0 I&#8217;m anxious to hear the debates about executive privilege and &#8220;signing statements.&#8221; The last session on Guantanamo Bay also promises to be intriguing.<\/p>\n<p>If you&#8217;re interested in the <a href=\"http:\/\/academic.scranton.edu\/department\/wml\/schemel.html\">Schemel Forum<\/a>, now is a great time to sign up for two of the upcoming Forums &#8212; Dr. William V.
